Terms of Use

The rules for using BugLens. The important one in a single sentence: identification is done by AI and can be wrong — never touch or approach a creature because of what the app told you.

1. Who provides the service

The service is provided by Top App, Rynek Główny 28, 31-010 Kraków, Poland, VAT ID PL6762666433. Contact: hello@topapp.pl. By using BugLens you accept these terms.

2. What BugLens is

BugLens identifies insects and other arthropods in photographs using an AI model, describes the species it recognises, and lets you build a collection of your discoveries. There is no sign-up — the app is issued an anonymous identifier that serves as your account.

3. Safety — please read this one

Identification is AI-generated and can be wrong. The model can confuse a harmless species with one that stings, bites or is venomous. Therefore:

  • Never touch, handle or approach a creature because the app said “harmless”.
  • Observe from a safe distance.
  • If you are allergic to insect venom, stay well clear of bees, wasps and hornets regardless of what the app shows.

Everything in the app is for information only and is not medical advice, veterinary advice, or professional pest-control advice. For a sting, a bite, an allergic reaction, or worrying symptoms in a pet, contact a doctor or a vet — in an emergency, emergency services. Removal and prevention steps are followed at your own risk; if you suspect an infestation, engage a professional.

4. Acceptable use

By using the app you agree not to:

  • upload photographs you have no rights to, or photographs of people without their consent;
  • upload unlawful, abusive or age-inappropriate content;
  • circumvent usage limits, automate requests, or load the service beyond normal use;
  • use the app in any setting where a wrong identification could endanger health, life or property.

We may restrict or withdraw access if these rules are broken.

5. Your photographs

Your photographs remain yours. You grant us only the licence needed to run the service: to send a photo to the AI model for identification and, if you save it to your collection, to store it and show it back to you. We do not use your photographs for anything else, do not publish them, and do not share them with other users. The licence ends when you delete the photo or your account.

6. Free tier and the BugLens Pro subscription

The app is free to download and use with a limited number of AI identifications. Once those run out, further identification requires a BugLens Pro subscription.

  • Current prices and billing periods are shown in the app before purchase, in the currency of your App Store account.
  • Payment is taken by Apple. The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
  • You manage and cancel the subscription in iPhone Settings → your Apple Account → Subscriptions. We have no technical means of cancelling it for you.
  • Payment disputes and refunds are handled by Apple under App Store policy.

As a consumer in the EU you generally have a 14-day right to withdraw from a contract for digital content. By starting to use paid identifications within that period, at your express request, you lose that right in respect of the part already performed. This does not affect your statutory consumer rights.

7. Availability

We work to keep the service available but do not guarantee uninterrupted operation. Identification depends on a third-party service (OpenAI) and may be temporarily unavailable. We may develop, change and retire features; material changes will be announced in advance.

8. Liability

The service is provided with due care but without a warranty that every identification will be correct. We are liable for damage caused intentionally and to the extent mandatory law requires — in particular we do not exclude liability for personal injury, nor consumer liability where the law does not permit exclusion. Beyond that, we are not liable for the consequences of decisions taken solely on the basis of an identification result.

9. Privacy

How we handle data is set out in the BugLens Privacy Policy.

10. Changes to these terms

We will announce material changes in the app before they take effect. Continuing to use the service after that date means you accept the new version; if you do not, you can delete your account in the app’s settings.

11. Governing law and disputes

These terms are governed by Polish law, which does not deprive you of the protection of mandatory rules in your country of habitual residence. Send complaints to hello@topapp.pl — we reply within 14 days. As a consumer you may also use out-of-court dispute resolution, including the European Commission’s ODR platform.

12. Credits

Species identification uses OpenAI vision-language models. Subscriptions are handled by RevenueCat.
